Changes to the Citizenship Act on October 11, 2017

2017년 10월 11월에 발효된 캐나다 시민권 신청 자격에 대한 변경 사항입니다.

On October 11, 2017, some changes to the Citizenship Act as a result of Bill C-6 become LAW, Here are some of the changes that you need to know about before applying for your citizenship.

• 거주 조건  Physical Presence
  최근 5년 내에 3년간 캐나다에 거주 ( 연간 최소 거주 일수 제한 폐지)
  
  You must be Physically Present in Canada for 3 out of the last 5 years.
  
  
• 언어 능력  Language and Knowledge
  18세 ~ 54세까지 언어(불어 혹은 영어) 요구 레벨 및 시민권 시험 통과
  
  You must meet language (English or French) requirements.
  
  
• 영주권자가 되기 전에 캐나다에 거주한 기간 포함  Days spent in Canada before Permanent Resident
  임시 채류 혹은 보호 신분으로서 캐나다 시민권 신청 이전 5년 동안 캐나다에 거주한 일자의 50%, 최대 1년(365일)까지 거주일자로 산정
  
  Days spent in Canada before becoming a permanent resident, as a temporary resident or protected person, within 5 years of applying for citizenship, Count As 1/2 Days, up to a maximum of 1 year (365 days).
  
  
• 소득 신고  Canadian Income Taxes
  실제 거주 기간 동안 5년 내에 3년간 소득 신고해야 함.
  
  You have to file Canadian Income Taxes (if required to do so under the Income Tax Act) for 3 out of 5 years, matching the new physical presence requirement.
  
  

PR카드 갱신 시, 부득이 해외로 출국해야 할 경우에는 미리 출국 지역 Visa Center에 PRTD를 신청해서, 입국 시에 Travel Document를 제시해야 입국이 가능하다.

흥미로운 것은, Private Vehicle로 이동하면 PR이나 PRTD가 없어도 입국이 가능한 것 같다.

A PRTD will let you re-enter Canada if you don’t have a PR card. Without a PR card or a PRTD, you won’t be able to travel to Canada except by private vehicle.

심지어 일단 귀국 비행기만 타면, 입국 시에 신분을 확인할 수 있는 다른 서류가 있으면 입국이 가능한 것 같다. 기타 다른 언급된 서류 중에 Enhanced Driver's License가 있는데, 이건 시민권자에게만 발행되는 것 같다.

If you do not have a passport, and are returning to Canada, the following documents can denote identity and/or citizenship:

• NEXUS card, held by a Canadian citizen, when entering Canada by air (when coming from the U.S.), land, or marine modes
• FAST card (Free and Secure Trade), issued to a Canadian citizen (when arriving by land or marine modes only)
• Canadian Emergency Travel Document
• Canadian Temporary Passport
• Certificate of Canadian Citizenship (issued from 1954 to present)
• Enhanced Driver's License issued by a Canadian province or territory
• Enhanced Identification/Photo Card issued by a Canadian province or territory

Permanent residents of Canada who are members of the NEXUS or FAST programs must travel with a passport and proof of permanent residence, and may be asked to present these documents to the officer upon arrival at the border.
